The Conceptual Structure of the Laws of Eshnunna
Hyun Chul (Paul) Kim
This paper attempts to find the intrinsic logical pattern, sequence, and structure in the Laws of Eshnunna
(LE) by utilizing form-critical analysis. Instead of tearing down and rearranging the text, this study will
use a careful analysis of the extant text as a whole through a heuristic approach. The investigation reveals
that there is a logical structure in the LE. It further shows that there is continuity and discontinuity in
the inter-relationships of the sections. Each section is interdependent upon its neighboring sections,
functioning as their basis, bridge, or application. There is also a conceptual hierarchical order within the
blocks of sections, that are controlled by various underlying concepts of a mutual contract system. In addition,
the underlying concepts depict the functions of the law in the agrarian Eshnunna society where boundaries of
polar cases can both clarify possible nebulous situations and help protect peoples' rights.
