World War II Pacific Theater Case Synopses from Judge Advocate's Reviews Yokohama Class B and C War Crimes Trials
Defendant: Kimura, Yukinaga, Umeda/Umoda PW Camp, Osaka, Japan

Docket No./ Date: 159/ April 17-18, 1947, Yokohama, Japan

Charge: Violation of the laws and customs of war: 1. Did willfully and unlawfully mistreat and abuse PWs (spec 1,2,5,9,10)

Specifications: beating using a club; kicking

Verdict: 7 years CHL

Reviewing Authority's Recommendations: Accused beat PWs with a club; these beatings followed without provocation mentioned or despite other Japanese telling the accused that a PW was not responsible for violations of the rules or for actual violations of the rules (drinking, not having a hat on straight).

Reviewing Authority: Denied all charges.

Prosecution Arguments: There are no errors or irregularities which injuriously affect any substantial rights of the accused; there is no evidence that the accused was not sane at the alleged time of the offenses or at the time of trial. There is sufficient competent evidence in the record to support the findings and sentence of the Commission.
