A man in a prison uniform takes a gun and shoots another man running way from him. He does this in full view of many witnesses. Nobody tries to stop him and he is not punished in any way. Why not?

All of the witnesses are prisoners and nobody wants to blow the whistle on him because they are afraid of him.
