Jack is an FBI sniper and he receives orders to take out Tom immediately with his sniper rifle, since Tom shot a police officer. Tom is unarmed standing in the middle of the roof, and clothes he's wearing are the only items he has on him. And even though Jack has a clear shot at Tom, and he recognized his face, he decides on his own not to fire then and there. Why? Note that his decision had nothing to do with his emotions.

Tom did not shoot because he has just realized his religion prohibits him from killing.... (yes I know, doesn't really work considering that any such person would not even possess a job that involves killing, but as an initial burst I feel that it is a creative answer ) Maybe a festival or parade is going on in the streets, and he doesn't want to draw attention. (killing is a secretive business, ya know ) Maybe he realizes that the man is the father who left his mother when he, the sniper, was only a baby. And, though not feeling emotionally obliged to save his life, does so simply because his father's death might bring attention to his own identity, or heighten his mother's own distress (for a sniper this is not emotional...just pure fact ). Ok if I keep going I will continue to give you more cockamamie ideas...so for the readers' sake, and yours...I will stop . But please...let me know if anything is leaning in the right direction .

Those are the best kind of riddles. However they are also the most torturous upon the mind. Grrrrrrr. Well if this criminal is high profile, which is highly possible considering the fact that someone is WAITING to kill him, then perhaps another sniper has assumesd the duty of killing him so the original sniper (i don't remember the names, sorry) has simply backed down. (once again....mildly inane...but inanity is the stuff riddles are made of ). I will try again soon...I want to be one of those people who proudly solves a riddle and then proceeds to make some ramen noodles. hahah.
