A minor quibble turns into a death

John is angry at Roger for some unknown reason. (edited) Suddenly they start fighting. They each bring out knives and duke it out. Eventually they end up on a balcony 10 stories high. John pushes Roger over the edge and Roger (edited lol. It said John before) is dead. The strange part about this is that an onlooker was charged for the death. In fact Roger himself had no charges at all. He was free. The onlooker had the whole blame. Whats going on? Why did the onlooker get charged? Note : Onlooker never spoke to either john or roger. Note 2 : Onlooker had no involvement in the fight that was going on. He did not "rig" the balcony in anyway to kill John.

Errr.. Could you rewrite it so it makes more sense? Because it doesn't make sense for Roger to cheat on John's wife. Or for John to push Roger over a Balcony and dying himself. Generally the person falling dies..

The onlooker never got a good look at John who was on the tenth story of the building. John escaped from the building as soon as he pushed Roger off, and the onlooker was the closest person to the body when the police arrived. The police charged him because John identified and testified against the onlooker as the murderer. (morbid and stretchy, but this is inspired by something that I heard about, two "witnesses" were actually the murderers and the scapegoat was on deathrow for about 5 years before they found out that he was innocent)

Well the answer I was going for was that roger and john were actors and the guy who was an onlooker was actually the guy who made the stunts and props safe etc. When the guy died the net to save him broke through. Therefore the onlooker got charged.
