To plan a robbery

Two men, who just robed a bank branch office, are running from a policeman, one with a toy pistol tucked in his belt, and the other holding a real gun and a bag full of money. Prior to this, nobody saw them threw their masks in a trash can, which they did because they had no place to hide them properly, being dressed lightly. Anyway, there is a patrol car in front of them, so they find themselves in a sandwich. At this moment, while policemen are slowly approaching them, one of them asks another for a favor before they get handcuffed, stressing he has mouths to feed. So even though they were both arrested, one of them was set free, meaning that all charges against him were dropped. What was the reason for his luck?      
 
 
 
I must apologize for deleting the 2nd riddle. A riddler showed me where I was wrong. Embarassed The only thing that is good about it is SWF's whish coming true.

Why do these alien What Happened riddles so often come in pairs? I guess thsi pair makes sense because a similar answer fits both.
 
1. One robber shoots and the other right before they are arrested. Later he dies from the injury, and the police have no reason to press charges against a dead man. The life insurance of the dead robber takes care of the mouths that need to be fed.
 
2. He dropped the shotgun because he was shot in the back by Jimmy's wife.
 
That is a tough neighborhood.

I can come up with all sorts of them, such as
 
(2) A rule for robbers: If you must commit a robbery immediately after competing in a greased-pig chase, take time to stop and wash your hands first!

2) Jimmy's wife doesn't need to be in the store to shoot the robber.  Alternatives are that the robber died from natural causes while trying to rob Jimmy, or Jimmy just gave him the money and the robber went away peacefully.

I guess this answer of yours is similar to mine, plus this riddle is getting on my nerves, so yes, you got it. I saw the intended answer in a movie, when he said that he was running away from the robber, not with the robber. So he saw his gun, got scared, and it just happens that he has a toy pistol, which is a present for his son. Sounds a bit silly to me though, so I suggest that moderators delete this one too.
